Cancellation and Refund Policy

Acceptance of the Offer creates an obligation to pay for the IP Shares. Once payment has been made in full and an entry has been made in the Register, the IP Shares are deemed transferred and no ordinary contractual refund is available.
Funds credited to the balance in the SWC Personal Account but not debited in payment for IP Shares constitute a prepayment by the Buyer. The Buyer may withdraw the unspent balance at any time upon request, regardless of whether the Buyer participates in the round and irrespective of the refund provisions described in §§3–7 of the Offer (which apply only to IP Shares that have already been paid for).
The Buyer may submit a cancellation request through the Personal Account before an entry is made in the Register. The request will be considered by the Administrator together with the Seller. A refund will be made where required by applicable law or voluntarily approved by the Seller.
Failure to achieve the minimum target amount does not create an automatic right to a refund. The Seller may close or extend the round or voluntarily refund the funds. Nothing in this provision excludes any right that cannot be excluded by agreement under mandatory provisions of UAE law.
If the agreement cannot be performed as a result of KYC/AML checks, the funds shall be handled in accordance with mandatory provisions of UAE law. A refund may be suspended or prohibited if the funds are blocked or notification to a competent authority is required.
Where approved or required, a refund shall be made by the same method or to the Buyer’s verified account following renewed verification. The Buyer bears any exchange-rate difference and non-refundable fees to the extent permitted by law.
A request must be submitted through the SWC Personal Account or by email to the Administrator at compliance@swcfield.com and must state the User ID, identify the payment and grounds for the request, and provide bank details. The Administrator will acknowledge receipt within five Business Days; the final decision will be communicated within 30 Business Days unless a shorter period is required by law.
